In China wurde das Strafprozessgesetz im Jahr 2012 novelliert und dabei ein neues Instrument der Strafjustiz — "Täter-Opfer-Ausgleich (TOA)" — eingeführt, nämlich der sog. "Vergleich zwischen den Parteien bei öffentlicher Anklage". Im Vergleich dazu wurde der TOA in Deutschland ungefähr 18 Jahre früher durch das Verbrechensbekämpfungsgesetz ins StGB eingeführt. Die gesetzlichen Konzeptionen des TOAs in China und Deutschland sind unterschiedlich und nicht perfekt. In dieser Arbeit wird die Untersuchung des TOAs im Rahmen eines Strafverfahrens in China und Deutschland in rechtsvergleichender Sicht durchgeführt, um eine optimale Konzeption des TOAs zu finden.
