Gegenstand dieser Publikation ist eine rechtswissenschaftliche Untersuchung von Forschungs- und Entwicklungsverträgen zwischen dem öffentlichen Auftraggeber und Industriefirmen im wehrtechnischen Bereich. Trotz eines Auftragsvolumens von fast 1 Mrd Euro jährlich wurde diese Thematik in Rechtsprechung und Literatur bisher kaum behandelt. Die derzeit konträr geführte Diskussion über die Beschaffung von Waffensystemen für die Bundewehr zeigt, wie brisant und hochaktuell diese Auseinandersetzung ist. Besondere Bedeutung kommt dabei den «Allgemeinen Bedingungen für Entwicklungsverträge mit Industriefirmen» (ABEI) zu. Die Autorin setzt sich kritisch mit den derzeitigen Regelungen auseinander und unterbreitet praxistaugliche Vorschläge für eine neue rechtssichere und ausgewogene Vertragsgestaltung.
