Im Vergleich mit der alten Richtlinie wurden zahlreiche neue Verbraucherschutzinstrumente in der neuen Richtlinie eingeführt: Vollharmonisierungsprinzip, vorvertragliche Pflichten des Kreditgebers, Kündigungsrecht bei unbefristeten Kreditverträgen, Widerrufsrecht, vorzeitige Rückzahlung usw. Neben einem erhöhten Verbraucherschutzniveau führten die neuen Instrumente zu umfangreicher Diskussion in der Literatur und Praxis. Die Verletzung von Pflichten führt nicht nur zur verwaltungsrechtlichen Sanktion, sondern auch zum zivilrechtlichen Schadensersatzanspruch. Der Schwerpunkt liegt in dem zivilrechtlichen Schadensersatzanspruch bei Verletzung der Bonitätsprüfungspflicht durch die Kreditgeber. Zielt diese Pflicht auf den Verbraucherschutz hin, sind die Verbraucher bei Pflichtverletzung durch die Kreditgeber zum Schadensersatz berechtigt. Diesbezüglich sind z. B. die Festlegung des Schadens, die Geltendmachung des Anspruchs sowie die Festlegung der Fälligkeit und Zinsen bei Überschuldung der Verbraucher umfassend zu erörtern.
