This book results from the collaboration of authors who participated in the panel “Bosnia after Sejdic-Finci case,” moderated by Professor Rainer Arnold at the Inaugural Conference of the International Society for Public Law in Florence, Italy, in June 2014. The authors assess the concept of “constituent peoples” and the discriminatory voting model within Bosnia and Herzegovina's constitutional framework. They propose various solutions to the issues highlighted by the ECtHR's Sejdic-Finci decision, which has remained unimplemented since 2009 despite support from local and international stakeholders. Alongside a critical analysis of official implementation proposals, the authors explore reasons for the failures in this process. The book also addresses differing perspectives among the constituent peoples, “the Others,” and the International Community regarding Bosnia and Herzegovina's future. It emphasizes the need for a more proactive role of the Constitutional Court in implementing the Sejdic-Finci decision and subsequent decisions aimed at aligning the Constitution with fundamental democratic values.
